Terms and Conditions for the bikes rent from MTB RENT in Sopot
Effective from March 20, 2025

I. Definitions

In this document, the following definitions are used, which appear in the text with capital letters, in singular or plural form:

1. Operator – MTB RENT, email address: biuro@mtb-rent.pl.

2. Service – the online service available at www.mtb-rent.pl, through which the Operator provides registration forms and general information about bikes available for rental at the MTB RENT bike rental location.

3. Regulations – these terms and conditions, which serve as the legal foundation for using the Service and the bike rental process.

4. User – a natural or legal person, or an organizational unit without legal personality, who uses the Service, utilizes the registration forms, and can review information about available rental bikes at the MTB RENT bike rental location.

5. Renter – a natural or legal person, or an organizational unit without legal personality,

who rents a bike from MTB RENT.

6. Lessor – the business entity providing the bike rental service.

II. General Provisions

1.These Regulations define the rules for using the Service by Users and the terms for service provision by the Operator. The Service is run and administered by the Operator. To use the Service, the User must meet the following minimum technical requirements:

- Have a computer or other multimedia device with internet access,

- Have an up-to-date web browser with JavaScript and cookies enabled,

- Have an active email account,

- Have a program to open PDF files to read documents sent to the User's email.

2. To ensure the security of messages and data transferred through the Service, the Operator takes appropriate technical and organizational measures to prevent unauthorized access to or modification of the data transferred via the internet.

III. Bike Reservation for Rent

1. A bike reservation request can be submitted by call +48 720-720-110, by send a request via the contact form or directly by email biuro@mtb-rent.pl.

2. Sending a reservation request does not mean that the bike has been reserved. The bike reservation will be confirmed by the Service Operator or an authorized representative of MTB RENT bike rental.

IV. Renting a Bike

1.Renting a bike is subject to the acceptance of these Regulations, which will be provided to the Renter to review at the MTB-RENT rental location. The Regulations must be accepted by the Renter before the bike is issued.

2. When collecting the bike, the Renter must present an identity document.

3. The rental fee is collected in advance.

4. Acceptable payment methods include bank transfer, BLIK, credit/debit card, or cash.

5. The rental price list is available at the rental location, and a partial overview is available on the Service website.

6. A deposit of 1000 PLN is required from the Renter before issuing the bike.

7. The Lessor reserves the right to refuse to rent a bike without giving a reason.

V. Using the Bike

1. The bike provided to the Renter at the MTB-RENT rental location is technically functional, and the Renter accepts its condition upon collection.

2. The Renter is responsible for the bike and any damage that occurs from the moment of rental until the bike is returned, which must be confirmed by an authorized representative of MTB RENT.

3. In case of damage, the Renter will cover the repair cost, which will be deducted from the deposit. In the case of irreparable damage, the Renter will cover the cost of purchasing a new bike or its equivalent.

4. In the event of theft, the Renter must report the incident to the Police, immediately inform the Lessor, and provide the Lessor with a certificate issued by the Police.

5. Minors may use the bike only under the supervision of an adult who is the actual Renter and takes responsibility for the use of the bike.

6. The Renter is responsible for any incidents, including accidents, injuries, or property damage related to bike use.

7. It is prohibited for the Renter to repair or modify the bike.

8. Any damage to the bike that prevents further use must be immediately reported to the Lessor by phone at +48 720-720-110. The Lessor will then provide information on how to return the bike to the rental location or another location specified by the Lessor.

9. The bike may not be shared with third parties or used under the influence of alcohol or other intoxicants.

10. Transporting the bike by other means requires the Lessor's consent.

11. Transporting the bike outside of Poland is prohibited.

VI. Returning the Bike

1. The bike must be returned on time and according to the rental agreement.

2. If it is impossible to return the bike by the deadline stated in the rental agreement or by 18:00 on the return day, the Renter must immediately inform the Lessor by

phone at +48 720-720-110. The Lessor reserves the right to report this to the Police, which may lead to legal consequences for the Renter.

3. The deposit will be returned at the end of the rental agreement, and in the case of damage to the bike or other issues, such as a delay in returning the bike, the Lessor may deduct the cost of the damage from the deposit.

VII. Extrajudicial Methods for Handling Complaints and Claims

1. The User or Renter who is a Consumer may use the following extrajudicial methods for handling complaints and claims:

Submitting a request to the Provincial Inspector of Trade Inspection to initiate a mediation procedure aimed at amicably resolving the civil dispute between the Consumer and the Operator or Lessor,

Submitting a request to a permanent consumer arbitration court operating under the Provincial Inspector of Trade Inspection to resolve a dispute between the Consumer and the Operator or Lessor.

2. Information on the principles and procedures of the mediation process conducted by the Provincial Inspector of Trade Inspection is available at the offices and websites of individual Provincial Inspectorates.

3. The User or Renter who is a Consumer can obtain free assistance in resolving a dispute between the Consumer and the Operator or Lessor from the local consumer ombudsman or a consumer protection organization.

4. Detailed information on extrajudicial methods for handling complaints and claims is available at the offices and websites of local consumer ombudsmen, consumer protection organizations, and Provincial Inspectorates.

VIII. Final Provisions

1. In the case where the User or Renter is a Consumer, any provisions of the Regulations that limit the rights of the Consumer or limit the responsibility of the Operator or Lessor towards the Consumer do not apply unless allowed by law.

2. In the case where the User or Renter is a business, the provisions of the Civil Code apply to matters not regulated by these Regulations.

3. In the case where the User is a business, the parties agree that any disputes between them will be resolved by the court competent for the location of the Operator or Lessor.

IX. Personal Data Processing

The personal data provided by the User are processed according to the Privacy Policy, available as a separate link on the Website.

In accordance with the GDPR, the personal data of the User and the Renter will be processed for the purpose of executing the rental agreement and using the features of the Service. The data controller is MTB-RENT. The Renter has the right to access and correct their data. According to Article 13(1) and (2) of the Regulation (EU) 2016/679 of the European Parliament and Council, we inform that the personal data of the User and Renter will be processed for the purpose of executing the rental agreement and using the Service.

The controller of the data provided by you is the Operator of the service.

Your personal data may be shared with our partners who provide hosting services and assist with the operation of the Service.

Your personal data will be stored until you revoke your consent for its processing.

What rights do you have?
You have the right to access, correct, delete, or limit the processing of your personal data, as well as the right to object to processing, request cessation of processing, and data portability, the right to withdraw consent at any time, and the right to lodge a complaint with the supervisory authority.

Is providing personal data mandatory?
Providing your personal data is voluntary, but failure to provide it will result in the inability to respond to your inquiries.

Will personal data be processed automatically?
The personal data you provide will not be processed automatically, nor will it be subject to profiling.

This regulation is an integral part of the rental agreement and serves as its annex.
